Steven Monjeza and Tiwonge Chimbalanga face 14 years in jail
(AFRICA) A Malawian judge today rejected the bail application of two gay men who have been charged with public indecency after participating in a public engagement ceremony. The judge believes the couple is safer in police custody.
Said Judge Nyakwawa Usiwa-Usiwa, "The accused have the right to bail but considering the public interest their case has generated, it is the view of the court that they are safer in police custody than out there."
The judge has, however, agreed to grant the couple bail on January 10th if prosecutors are unable to complete their investigation by that time.
Homosexuality is illegal in the conservative African state and carries a maximum prison sentence of 14 years. The pair face three charges of unnatural practices between males and gross indecency.
